Terms of Service

Please read these Terms of Service (“Terms”) carefully before using Sports Snaps. These Terms form a legally binding agreement between you and Sports Snaps (“we,” “our,” or “us”), governing your use of the Sports Snaps mobile application and website at mysportssnaps.com (collectively, the “Service”).

By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who May Use the Service

You must be at least 18 years old to create an account. The Service is designed to be used by parents, guardians, coaches, and other adults on behalf of youth athletes. Children under 13 may not create accounts or directly use the Service. If you are between 13 and 17, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to these Terms on your behalf.

By using the Service you represent and warrant that you meet these eligibility requirements.

2. Account Registration and Security

To access most features you must register an account using your email address. We use magic-link sign-in — we send you a one-time link and we do not store passwords. You agree to:

• Provide accurate and current information.
• Keep your magic links confidential and not share them with others.
• Notify us immediately at support@mysportssnaps.com if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

We may require you to verify your identity or re-authenticate at any time. We reserve the right to disable accounts that appear to be compromised or in violation of these Terms.

4. License You Grant Us

You retain all ownership rights to the photos you upload. By uploading a photo you grant Sports Snaps a limited, non-exclusive, royalty-free, worldwide license to:

• Store, process, and transmit the photo in order to provide the Service (including sending it to our AI-processing partner).
• Generate AI-enhanced versions of the photo on your behalf.
• Reproduce the photo and its enhanced versions to fulfill print orders you place.
• Display thumbnails or previews of the photo and enhanced versions within your account.

This license is strictly limited to operating the Service for you. We do not use your photos to train AI models, display them publicly, or share them with third parties except as described in our Privacy Policy.

5. AI Photo Enhancement

Sports Snaps uses a third-party AI platform (Replicate) to generate enhanced versions of your photos. By requesting an enhancement you acknowledge that:

• Results vary.AI enhancement is a generative process. Output quality depends on the original photo’s composition, lighting, and resolution. We do not guarantee any specific result.
• Processing time. Enhancements typically complete within a few minutes but may take longer depending on service demand.
• Third-party processing.Your original photo will be transmitted securely to Replicate. Replicate may temporarily retain inputs and outputs subject to their own terms and privacy policy. We do not control Replicate’s data-handling practices beyond our contractual protections.
• No commercial resale of enhanced images. You may print and display enhanced photos for personal, non-commercial use only. You may not resell, license, or commercially exploit enhanced images without our prior written consent.

6. Orders, Payments, and Refunds

Pricing and payment

Prices are displayed in USD and are subject to change. Payments are processed by Stripe. By completing a purchase you authorize us to charge the payment method you provide. All charges are final when an order is placed unless otherwise stated below.

Digital downloads

Digital downloads are delivered electronically and are generally non-refundable once fulfilled. If you experience a technical failure that prevents download, contact us at support@mysportssnaps.com within 7 days and we will re-deliver or issue a refund at our discretion.

Print orders

Physical prints are produced and shipped by a third-party fulfillment partner. Production typically begins within 1–2 business days of your order; you will receive a tracking number by email once your order ships. Estimated delivery times are provided at checkout but are not guaranteed.

If your print arrives damaged or is the wrong item, email us at support@mysportssnaps.com within 14 days of delivery with a photo of the issue. We will reprint or refund at our discretion. We do not accept returns for “I changed my mind” or image-quality issues that were present in the original photo you uploaded.

Taxes

Prices displayed do not include applicable sales tax, which will be calculated and displayed at checkout where required by law.

7. Prohibited Uses

You agree not to use the Service to:

• Upload photos you do not have the right to use (see Section 3).
• Upload photos that are sexually explicit, obscene, or depict child sexual abuse material. We report any such content to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement.
• Upload photos that harass, defame, or threaten any individual.
• Attempt to reverse-engineer, scrape, or extract data from the Service beyond normal use.
• Use automated tools (bots, crawlers, scrapers) to access the Service without our written permission.
• Circumvent, disable, or interfere with security features of the Service.
• Violate any applicable local, state, national, or international law.
• Impersonate another person or misrepresent your affiliation with any entity.

We reserve the right to investigate and take appropriate action, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

8. Intellectual Property

The Sports Snaps name, logo, app design, software, and all other content we create are protected by copyright, trademark, and other intellectual-property laws and are owned by Sports Snaps or our licensors. These Terms do not grant you any right to use our marks or content outside of using the Service as intended.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes.

9. Copyright Infringement (DMCA)

If you believe that content on the Service infringes your copyright, send a written notice to legal@mysportssnaps.com that includes:

• Identification of the copyrighted work you claim has been infringed.
• Identification of the material you claim is infringing, with enough detail for us to locate it.
• Your contact information (name, address, phone, email).
• A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
• Your physical or electronic signature.

We will respond to valid DMCA notices and remove or disable access to infringing material as required by law.

10. Privacy and Children

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms. Please read it carefully.

The Service is not directed to children under 13. Account holders must be adults who are using the Service to process photos of athletes they have authority over (for example, as a parent or guardian). If you are a parent and believe your child has created an account without your knowledge, please contact us at legal@mysportssnaps.com.

11. Third-Party Services

The Service integrates with third-party platforms including Stripe (payments), Replicate (AI processing), Supabase (infrastructure), and a print-fulfillment partner. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the practices of those third parties, but we select and contract with them to ensure appropriate data protection standards.

The Service may contain links to external websites. We do not endorse and are not responsible for the content or practices of those sites.

12. Disclaimers

Read carefully — this section limits our liability

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. To the fullest extent permitted by law, Sports Snaps disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) AI enhancements will meet your expectations or be suitable for any particular purpose; (c) print orders will arrive by any specific date; or (d) any defects will be corrected.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Sports Snaps and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or loss of goodwill, arising out of or relating to your use of or inability to use the Service.

Our total aggregate liability to you for any claim relating to the Service will not exceed the greater of (a) the total amount you paid to Sports Snaps in the 12 months before the claim arose, or (b) USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Sports Snaps and its officers, employees, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual-property or privacy rights; or (d) any content you upload to the Service.

15. Termination

We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. You may also delete your account at any time by contacting us at support@mysportssnaps.com.

Upon termination, your license to use the Service ends immediately. Provisions of these Terms that by their nature should survive termination (including Sections 3, 4, 12, 13, 14, and 16) will continue to apply after termination.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Georgia, without regard to its conflict-of-law provisions.

Informal resolution: Before filing any legal claim, you agree to contact us at legal@mysportssnaps.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration: If informal resolution fails, any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Exceptions: Either party may seek injunctive or other equitable relief in court to protect intellectual-property rights or prevent irreparable harm. You may also bring a claim in small-claims court if it qualifies.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by a prominent notice in the app at least 14 days before the changes take effect. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the new Terms.

The “Effective date” at the top of this page always reflects the current version. We recommend bookmarking this page and reviewing it periodically.

18. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sports Snaps regarding the Service and supersede any prior agreements. If any provision is held invalid or unenforceable, the remaining provisions will continue in full force. Our failure to enforce any right does not constitute a waiver of that right.

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of our business.
